Franco Moroney Buenik attorney Christopher G. Buenik prevails in motion to dismiss plaintiff’s complaint in personal injury lawsuit. In Schott v. Enterprise Leasing Company of Chicago, LLC et al., the plaintiff filed an amended complaint against Front Line Transportation for personal injuries alleging that he was injured when the forklift he was operating fell of a dock while loading an Enterprise leased truck. Front Line Transportation filed a motion to dismiss based upon Section 5(a) of the Workers’ Compensation Act arguing that the plaintiff was a joint employee of Front Line Transportation and Horizon Logistics. Although the Plaintiff only filed a workers’ compensation claim against Horizon Logistics, the Court ruled that Front Line Transportation was entitled to immunity from plaintiff’s suit since it was a joint employer of the plaintiff.
