In Meza v. F.H. Paschen S.N. Nielsen/IHC Joint Venture, et al., 2010 L 4329, the Circuit Court of Cook County granted summary judgment in favor of the general contractor, F.H. Paschen (“FHP”). Mr. Moroney successfully argued the rehearing of the motion four days before the wrongful death case was set for jury trial. The plaintiff’s demand was $9 million. The lawsuit arose out of an accident where a subcontractor’s employee was killed on a job site when he was run over by a skid-steer owned by his employer. The Circuit Court found that FHP did not owe plaintiff a duty and did not proximately cause the accident. The case is now under appeal before the First District Appellate Court of Illinois.
